Minister Creecy publishes new Dust Control Regulations under Air Quality Act for public comment before 7 May 2024

On 8 March 2024, the Minister of Forestry, Fisheries and the Environment, published draft National Dust Control Amendment Regulations under the National Environmental Management: Air Quality Act for public comment. The notice indicates that 30 days for public comment are provided calculated from the date  when newspaper adverts of the gazette have been published. See here for the newspaper publication dated 7 April 2024.

The date for submission of public comments is therefore 7 May 2024.

According to the gazette, the purpose of the amendments is to address regulatory shortfalls that have been identified in the implementation of the existing National Dust Control Regulations.

The proposed amendments are aimed at providing clarity by:

  1. Defining activities that are applicable to the regulations.
  2.  Updating the standard test method for the collection and measurement of dustfall to a locally accessible method as adopted by South African Bureau of Standards.
  3. Improving requirements for the development, implementation, and procedural matters with respect to dust management plans; and
  4. Repealing the existing Dust Control Regulations.
