Amendments to MPRDA Regulations – increase in fees payable for onshore and offshore permits and rights

On 7 May 2024, the Minister of Mineral Resources and Energy amended Regulations 75 and 76 of the Mineral and Petroleum Resources Development Regulations (GNR 527 in GG 26275 of 23 April 2004). The amendment notice is available here. The amendments became effective on the date publishing in the gazette (i.e. effective fromĀ  7 May 2024).

The main change with regards to Regulation 75, is an increase in the application fees payable for onshore and offshore permits and rights, and the rate at which these fees will be increased every year from 1 April.

In the amendment to Regulation 76, Minister Mantashe distinguishes or separates the prospecting fees payable in terms of section 19(2)(f) and the exploration fees payable as contemplated in section 82(2)(e). As a result, Regulation 76 now deals only with prospecting fees payable in terms of section 19(2)(f), while the newly inserted Regulation 76(A)(1) deals with exploration fees payable as contemplated in section 82(2)(e).
